GIFT CARD TERMS AND CONDITIONS

1. General Provisions
1.1. The following terms and conditions of sale (“Gift Card Terms”) apply to the use of the gift card purchased by customers at the Swiss Post (“Gift Card”) on the La Mer website available at www.lamer.eu (the “Site”).
1.3. To be eligible to purchase products on the Site with the Gift Card, customers must: (a) be at least 18 years old or, if minors, be duly authorized by their legal representative; (b) be consumers, meant as natural persons acting for purposes extraneous to their trade, business, craft and profession; and (c) hold a valid credit or debit card.
1.4. These Gift Card Terms shall be executed in the official languages of Switzerland and shall be governed by the laws of Switzerland.
2. Where Can I Buy A Gift Card?
2.1. Gift Cards can only be purchased in Swiss Post stores who are proposing the Gift Card for purchase to customers. The amount of each Gift Card is in Swiss Francs and can be between CHF30 (thirty Swiss Francs) and CHF500 (five hundred Swiss Francs).
2.2. To find the Swiss Post store nearest you, visit https://www.post.ch/en/locations.
2.3. Cancellation of the Gift Card is handled by the Swiss Post at their own discretion. Any request to cancel the Gift Card or its refund should be addressed with the Swiss Post and We cannot be held responsible for any return, cancellation or refund of the Gift Card.
3. Where Can I Use My Gift Card?
3.1. The Gift Card can only be used as a means of payment on the Site.
3.2. The Gift Card is only valid for the purchase of goods or services on the Site. The Gift Card cannot be used on any other website or store and cannot be used outside of Switzerland.
3.3. The Gift Card is valid for a period of two (2) years from the date of purchase.
4. How Can I use the Gift Card?
4.1. The Gift Card can only be used in the case of full payment for products purchased on the Site.
4.2. All Gift Cards purchased at the Swiss Post stores have a PIN code.
4.3. In order to use the Gift Card to purchase products and/or services on the Site, you need to enter the PIN Code at the checkout. Once you have selected the products and/or services in your cart, you will need to select and click on “I have a gift card” and enter the Gift Card number and the Gift Card PIN code in the text fields and then click on “use”. Once your PIN code has been validated, you can proceed to confirm the payment of your order with the Gift Card.
4.4. Any issue with using the Gift Card (e.g. PIN code not working) must be reported as soon as possible to our Customer Service.
4.5. You can check your Gift Card balance amount at any time by completing the payment process and clicking on "Check Balance".
4.6. You can also check your Gift Card balance amount by contacting our Customer Service.
5. Lost or Stolen Gift Cards
5.1. We will not be held responsible for the loss, theft or damage of the Gift Card, whether or not it has already been partially used or not.
5.2. Gift Cards will NOT be replaced by us or refunded if lost, stolen or damaged. We will not be held responsible for any fraudulent use of your Gift card of which you are unaware.
6. Final provisions
6.1. The risk will pass to the customer upon purchase of the Gift Card at the Swiss Post.
6.2. Gift Cards purchased at the Swiss Post cannot be exchanged for cash by us.
6.3. Swiss Post is not directly related to Estée Lauder GmbH and cannot be held responsible for products and services offered on the Site. For the same reason, Estée Lauder GmbH cannot be held liable for services offered by the Swiss Post.
6.4. Your use of this Site is governed by the Terms and Conditions described in section 1.2 above.
6.5. Disputes arising from your use of this Site, the Gift Card and the services we provide are subject to the non-exclusive jurisdiction of the Swiss courts.
6.6. Force Majeure: We cannot be held responsible for a failure to fulfil our obligations under these Gift Card Terms when this failure is attributed to a reason entirely outside of our control. Examples of this may include, but are not limited to, natural disasters, trade disputes, government intervention, fire, flooding, epidemic, pandemic, quarantine restrictions, disruption of computers or IT infrastructure.
6.7. Violation of these Gift Card Terms will enable us to obtain the appropriate legal recourse to obtain injunctive relief, damages or otherwise as described in the Terms and Conditions.
